    I don't blame you. Bell is a huge disappointment. She's nice enough. She just doesn't seem to possess good legal reasoning skills. She sort of makes it up as she goes along. Unfortunately, the name alone will get her two more terms.

  4. Walsh. I know it is obvious, but she has made some of the strangest decisions I've ever witnessed. That blank botox stare. Can't take it.

    We are getting there with Miley at my firm.

    Denton if it is a case in which decisions will need to be made at an early stage.

  6. Stefany Miley in every civil case - she is dumb and unpredictable. Often we cannot discern what her ruling actually was and are left scratching our heads alongside opposing counsel. There is no clarity of thought at all with her. And while none of us has yet had a civil trial with her, we refuse to expose our clients to that risk.

    I have only been practicing here two and a half years after having practiced in another state for 17How did such a complete boob become a judge? Is the electorate here really that ill-informed?

  7. Mark Kabins pled guilty yesterday with little fanfare. Apparently he gets to keep his license to pracice medicine.

  9. What's the point of using a judicial challenge anyway? You still might draw another terrible judge (Walsh, Vega, Levitt, Williams, Miley, Smith, or Bixler). On the other than, terrible judges might help promote settlement. Think about it...

  13. Interesting bit of news today. David Schieck, THE Special Public Defender, was found to have offered ineffective assistance of counsel in a case. To be fair, I'm sure most defense attorneys have faced these claims, and many have lost.
    Case is Charlene Snyder. If anyone doesn't remember, this was a horrible child neglect case. Google the name.

    Unless you draw the undisputed least common denominator (and there are so many candidates here), why ding the judge?

    Walsh is bad, so are Smith, Williams, Vega (and Miley by reputation - I haven't had the "pleasure") . . .

  22. Oh, how wonderful, I have to send a check to a former Gage associate because he is running against Allf. Oh well, I have been known to send checks to Democrats, so why not to Gage-ites? Plus, he probably at least knows the rules of civil procedure.

  25. @ 9:52 so there's no longer any doubt that he completely blew the "do no harm" promise, doesn't even have to do time at Club Fed & keeps his license. Our system has gone completely haywire. And despite the tax evasion rap Awand is apparently still not threatened enough to give anything up. The blatantly corrupt are more organized & tight than the other side. What a crying shame.

  28. First of all, 8:23, get your facts straight if you want any credibility with your posts. Awand was never convicted of "tax evasion," but "failure to pay," which is a misdemeanor, and rarely commands any prison time, since we abolished debtor prisons as part of our "breaking away from England." Secondly, it is highly unlikely that the government is going to win their "fraud" trial since there is no evidence that Gage's decision was based upon corruption. The Judge is not going to allow Kabins to testify regarding his subjective beliefs. Third, you must not do much , if any, criminal law if you don't "get" why Kabins took this deal even if he was entirely innocent of wrongdoing. By the way, what evidence do YOU have that, apparently, the feds have not managed to find, or manufacture, since there are no indictments after 5 1/2 years after the investigation began. Also, how do you deal with those 5 year statute of limitations? Awand has been long gone for over 5 years now. Sorry, but looks like you will just have to beat Vannah and Eglet in court, the old fashioned way. Good luck with your trial skills.

  30. If you have to ask what is wrong with Steinheimer you either: (a) don't practice in 2nd Judicial regularly; (b) you're still wet behind your ears; (c) you've had your head buried in the sand for the last 10 years; or (d) all of the above.

  33. As for peremptory challenges, typically automatics would be Vega, Doug Smith and S-Miley. Smith is the worst, candidly I have never appeared in front of him in which he has read the pleadings. Recently he has taken to not understanding that "summary judgment" does not mean "summarily weigh the evidence and determine what I think is reasonable."

    If I am a Defendant, Willams. Good judge, at least to half the bar.
