Halverson's Federal Civil Rights Case/Motion for TRO

A few people wrote in asking for links to the Halverson Federal pleadings. However, blogger.com does not allow direct upload of .pdfs.

The highlights:

  • Halverson claims the Disciplinary Commission is conducting the hearing in a manner violating her rights in order to "generate[ ] so much adverse media publicity so as to deny her any chance for re-election" as a judge

  • She claims her rights were specifically violated by the Commission's decision that she could not delay the hearing to find new counsel, denial of the opportunity to interview witnesses and obtaining evidence though warrantless search and seizure of documents and other items

  • She requests: 1) a declaratory judgment that the Commission violated her rights, 2) a temporary restraining order halting the disciplinary hearing, 3) Plaintiff's costs and attorneys fees

Weirdly, she didn't request psychiatric costs for her emotional distress, which she suffers from because the Commission doesn't understand that she's bat-shit crazy and should be able to do whatever she wants as guaranteed by the Constitution.

  1. Halverson’s federal court lawyers emphasize their Family Law practice on the web, were admitted in 2005 and 2006 respectively, and both graduated from a Law School that no one has ever heard of: "UNLV Law".

    Anyhow, G. Luke Ciciliano Esq graduated from there in 2005. Therefore, he has been an attorney for 3 years.

    His law partner (and Halverson co-counsel) F. Peter James Esq ALSO graduated from the William S. Boyd School of Law, but passed the bar a year after Ciciliano in 2006.

    (And what’s up with their shared penchant for first initials in lieu of first names? They are emulating F. Lee Bailey ?)

  2. Halverson’s motion and incorporated affidavit implies that the pending disciplinary proceeding was initiated in retaliation for her reporting corruption at the 8th District Courthouse:

    “After Plaintiff discovered and requested that the Court Administrator investigate corruption in the Eighth Judicial District Court, she was removed from the bench pending the hearings at issue…”

    (Motion pp. 4 and 5.)

    For this to be true:

    1. The Court Administrator (and/or judges) must have had sufficient control over the Nevada Commission on Judicial Discipline AND the Special prosecutor to cause formal, retaliatory charges to have Halverson temporally suspended; AND

    2. The conspiracy must have been joined by the witnesses who testified against her at the hearing on the temporary suspension; AND

    3. The Nevada Supreme Court must have joined the conspiracy when it upheld the temporary suspension after a full and fair hearing based on the entire administrative record.

    What are the odds that the Court Administrator, the Court, the Commission on Judicial Discipline, the Special Prosecutor, and the entire Nevada Supreme Court are all part of a conspiracy to throw Halverson off he bench because she blew the whistle on Court Room Clerk Ilene Spoor’s alleged ticket fixing for friends and family?

    As if—even if corrupt and inclined to act in concert—all f these major players could give a s*** whether a minor court functionary gets away with fixing traffic tickets?

  4. Halverson's federal case requesting to stop her disciplinary hearing looks to have been denied according to KVBC, so her hearing will go on as expected today. Circus and all.

    Regarding the UNLV Law and "William S. Boyd School of Law" matter, the law school is named after it's largest benefactor "William S. Boyd". With its 10 year anniversary though, it has been referred to, at least on letterhead that I've seen and an updated logo, as "UNLV Law".

  7. hmmm...I don't think you guys are being very fair to Jabba. Looking at the scooter photo of Halverson, I think she has way more folds of flab. Jabba looks quite streamlined by comparison.
