Bad Service

Local process server On Scene Mediations, run by former Las Vegas police officer Maurice Carroll, is being investigated for allegedly submitting false affidavits claiming that it had served defendants with copies of lawsuits, resulting in default judgments being entered. From the RJ:
Court officials said they don't know how widespread the problem is; Logue estimated thousands of cases could be affected. He said records show that Carroll's company, which was run out of his North Las Vegas home, was doing about $50,000 in business a month, a large volume of work for a company of its kind.

Intelligence detectives raided Carroll's home on July 6, seizing financial and business records.

Detectives are now seeking an arrest warrant for Carroll, 42, who left the police department in 2000 after roughly 10 years of service, on possible charges of perjury and filing false court documents, officials said. Carroll could not be reached for comment.
Las Vegas JPs Melissa Saragosa and Diana Sullivan asked police to investigate after noticing numerous "irregularities." Basically, more than the usual number of defendants were showing up claiming they hadn't been served.

But don't worry, the Nevada Private Investigators License Board is on the case:
Mechele Ray, executive director of the Nevada Private Investigators License Board, confirmed that Carroll's company is not licensed to operate as a process server. She said her agency investigated a complaint against the company brought by Las Vegas justices of the peace, but she would not discuss the probe.

"We've taken what we feel is the appropriate action at this time," she said.

Independent contractors, such as Carroll, face fines of up to $10,000 if they fail to get a license after a warning from the Private Investigators Board, Ray said.
So, Carroll is doing $50,000 a month in business, and he gets "up to" a $10,000 fine after he receives a warning? Just another fine example of the cutthroat regulatory agencies we have in this state. That's sure to teach him.

    Why doesn't the PILB kick the crap out of these kind of F'd up folks.
    Like JT using police insders getting privileged info and getting officers canned for it.
    There are others that work in the state without any licensing, and the PILB are unable to follow through. Is the PILB so short handed or incompetent, they can't. Great State of Nevada

  2. I find it amazing the attorneys in this town will cozy up to a PI or process server and not know anything about their background.
    Do they even ask if they are licensed? Do they care? Lets see two process servers are out murdering and raping folks(they had no License) MC had a DV while working as a DV detective,that started his demise at Metro. PILB fined him and he kept going.
    Some PI's have no police backgrounds, some who claim to be PI's, only work for someonewho has a license.WTF. You get what you pay for. Sh*t work.

  5. Has anyone stopped to think that this absolutely innocuous, stupid story at any other time wouldn't even make the news....let alone front page of RJ and an actual "story" on TV news?
    There's multiple murderers, rapists, home invaders, etc with warrants...and they pick this guy?!?!?
    Oh yeah...he's a real threat to society. He MIGHT be making people pay their bills...without force, without coersion...OH MY GOD!!! How dare he! He's serving them Court Papers! What a horror!
    In our NEW USA we're not SUPPOSED to pay our bills! Goddamn it...this is a FREE country...in every sense of the word.
    Why in HELL should I pay....and if I sign and agree that I will pay? Well sheeeit, I'm just one of the undereducated, underappreciated, taken advantage of poor people that didn't know any better and was just doing what I could to survive.
    If I have to defraud a few companies to survive? Should I really be held accountable? If I decide to borrow $ and not pay it back is it really my fault? HELL NO! THEY'VE all got more than enough to cover it.
    So should I feel sorry for this sorry assed entrepeneur that decided to start a legitimate business instead of feeding off the government? HELL NO!
    Let him be like the REST of us and feed off the government...WELFARE and FREE MEDS for everyone....Idiots like this guy just make it harder for the rest of us recipients to push our agenda.

    You either never went to law school, or wento Cooley. Let me explain something here:

    The Constitution prevents the states and federal government from depriving anyone of their property without due process of law. Somehow the founders didn't take kindly to the king seizing their property without even telling them why they were now penniless.

    Part of the "due process" is the right to be notified when someone sues you, so that the court doesn't find against you without you having the chance to know what the claims are, and before you have the chance to defend yourself.

    Got that so far? Due process prevents Obama from taking your crap without giving you a chance to defend yourself. In order to defend yourself, you have to know when to show up.

    If you aren't told when to show up to protest someone taking your crap, your crap gets taken because the judge rules against you.

    Now, that's where the process server comes in. They tell you when to show up. They tell you when you can contest that, for example, some pest control scam kept billing you even after you canceled, and months after they never bothered to appear.

    Using the judicial process to scam people is a BIG story.

    Ya'know, I would much rather believe that your rant was simply an attempt to solicit some sort of heated, partisan response than to realize the alternative; you might be serious. But I digress, and reminisce on the first time I got some good book learnin' on due process - Constitutional Law and I was the most pathetic 1L imaginable. No no wait, PolySci,and I was the most pathetic freshman imaginable. Ahh ok, I just remembered. I was in high school, U.S. Government... and I was the coolest senior on campus!
    Due process: understanding its importance is(almost)elementary.
