Did the Miley Matter Just Disappear?

Do any of you remember a few months ago when a Judge's attorney husband smacked her around in front of their children and then choked the family dog to death before discharging a few rounds in his backyard? Anyone?

We thought that might ring a bell. We recently received an email inquiry that we wanted to put out there and see if any of you might have the answers (because we certainly don't). Here's part of the email:
I have heard from a very close friend in the DA's office that the charges for Ed Miley will be dropped. How can a violent Domestic Abuse charge with 2 counts of child indangerment and a felony for killing a dog be dropped so quickly and quietly?
...
This town is fixed. Really - I have cases I am working on now with domestic abuse where the husband did 1/3 of what Ed Miley did and the DA will NOT budge on these. He is pressing charges.
So, what do you think commenters ... is the fix in? Did the charges just vanish? We'll note for the record that the State Bar website still shows that no disciplinary action has been taken against Ed/Randy. Who's got the dirt?

UPDATE
Ask and we shall receive ... LV Now is reporting that Miley took a plea deal last month:
According to court records, Miley received a six month suspended jail sentence. He paid a $1,000 fine and must complete domestic violence counseling and community service.
Still no word on whether Randy will face the wrath of our State Bar .... or the status of the divorce proceedings (sorry guys).

Thanksgiving Leftovers

Apparently the shenanigans don't stop just because we take a long weekend. Here are some of the stories we missed while stuffing ourselves:

Attorney Michael Amador reportedly pulled a gun on someone in a bar on Wednesday night and was arrested. He had to be taken to the hospital before he was booked. Keep it real, G.

---------------------------------------

The LV Sun is reporting that Judge Hottie filed for divorce from Ed "Puppy Strangler" Miley on November 13 citing "incompatibility." The pictures on the right of the Sun's story will give you a little hint as to what that "incompatibility" was. We have conflicting information, however, because one of our commenters reported the following on November 22nd:
Was out this weekend and saw Randy and Stefany Miley. Apparently he is out of rehab. They were holding hands, kissing - lovy dovey stuff. So it looks like she has no backbone and is taking him back.
Sing it with us: Tale as old as time ...

----------------------------------------

State Senate Majority Leader Steven Horsford pulled a "Libo" outside the Aviary Park in North Las Vegas and got busted by Channel 13. Here's Horsford's explanation:
I apologize for any inconvenience I may have caused in inadvertently parking in an unauthorized parking space.
Inadvertently? Yeah, right. See the full story to get a feel for how big of a pussy the Senator is being over fessing up to his mistake.

----------------------------------------

Finally, Nevada Appeal is running an AP story that confirms U.S. Senate Majority Leader Harry Reid has interviewed both Clark County District Judge Elissa Cadish and Clark County Chief Deputy District Attorney Gloria Navarro to fill the open Sandoval/Jones U.S. District Court seat.

Las Vegas attorney Kathy England said Reid's consideration of the women is in line with President Barrack Obama's emphasis on diversifying the federal bench. Okeydokey. No more penises ... got it.

Looks like we have our short list, Cadish said she expects a decision "relatively quickly."

Followup Roundup

Happy Friday! We have a little potpourri of followup stories for you today:

First, remember our friend Chuck? Well, it turns out Chuck is stupid.

Only two days after the LV Sun published their story regarding his fraudulent activities, Chuck fell for an undercover sting that caught him in the act of practicing law without a license. From the LV Sun:
Tuesday’s sting was conducted after the Nevada State Bar asked police to investigate Radosevich for allegedly passing himself off as a licensed lawyer. He has never been one in Nevada and he was disbarred in Colorado and Nebraska.

Two Metro detectives posing as a couple went to Radosevich and asked him for legal help. The detectives paid Radosevich $200 for the services they requested and then disclosed their true identities and cited him.
Attaboy Chuck! If at first you don't succeed ...

--------------------

Next, the LV Sun is reporting that our old friend Ed Miley was a member of the State Bar's disciplinary board at the time he choked his dog to death while beating his hot wife in front of their children and firing a handgun in his backyard.

The money quote regarding the matter came from attorney Jeffrey Albregts, chairman of the Southern Nevada board, who said:
I don’t intend to appoint him to anymore disciplinary panels, I don’t think that would be beneficial or fair to everyone involved in those processes.
Good call, Jeff. We've additionally learned that Ed was the "model attorney" chosen to give last year's Bridge The Gap presentation on criminal law. Don't suppose he covered DV or cruelty to animals, did he?

According to the LV Sun, Ed is scheduled to emerge from rehab at the end of the month, and his arraignment in Las Vegas Justice Court has been put off until December 1st.

--------------------

Finally, it looks like Judge Cadish may have some competition for that empty U.S. District Court seat. The LV Sun is reporting that Chief Deputy District Attorney Gloria Navarro is on that same "short list" to fill the seat.

Navarro currently works in the district attorney's civil division, and before that she was a deputy special public defender.

Perhaps most importantly, however, she is a she.

Miley Non-Update

Many of you are clamoring for Miley news, and we just can't seem to get any rumors verified. So, in keeping with our "tabloid" moniker, here are all the rumors we have been able to gather [cue the slow, sappy background western music]:

So, when we last left our dysfunctional couple, Ed, in a drunken rage, strangled his dog to death and gave his hot judge-wife the 'ole what fer before deciding to play shoot-em-up with a live firearm in his backyard. This landed Ed a TRO from his home, his kids' school, and the RJC (big problem for an attorney).

After that point, the rumors get a little murky. Apparently the TRO was allowed to expire. However, Ed's current location is unknown. From what we've heard, he is in rehab in either California or Arizona (possibly court ordered).

As for Judge Hottie, she took a little vacation (do judges really have unlimited sick days?). She is reportedly back to work as of Monday.

But what about the relationship, you ask? Here's where things get real rumory. Those of you who are not daytime soap fans may wish to stop reading here.

Here's an email we received on the matter:
I heard Judge Miley told friends she is going to take him back. Not because she is so in love, but she is over in debt. She paid a lot for her house a few years ago in Red Rock and now she can't sell it for half the price she bought it for. She feels trapped with all of their debt and can't give up the life style she has created.

The cops who were there and arrested Ed - said the kids got their baseball bats, light sabors etc to try and get Dad off of their mom. He was attacking her and didn't stop. Judge Miley thought he was going to kill her then.
These are the days of our lives ...

That's all we've got. We'll leave it to you guys to fill in the blanks and/or tell us we're full of shit.

(Thanks, tipsters)

More Miley Details

Now that the dust has settled, some of our local news outlets are wringing more details from Cirque du Miley. Here are some of our favorites:
  • After choking his dog and shoving his wife in front of their children, Big Ed went all "gangsta," grabbed a gun, and fired off multiple rounds in the backyard of their home. (Fox 5 Video @ 1:07)

  • Good news for those of you looking to "court" a 38-year-old hot judge: Apparently Judge Miley initiated the argument by telling Ed she wanted a divorce. We expect to see her office filled with roses tomorrow morning. (LVRJ)

  • The status of the choked dog, while mentioned in almost every article, is still unknown. Someone get the status of that pooch!
  • LV Now is reporting that the dog was euthanized. Anyone know the dog's name?

  • Judge Miley was granted a temporary restraining order against Ed, forbidding him from coming within 100 yards of their home, their children's school, or her work. Too bad she works at the RJC, and he happens to be an attorney (for now). Guess there will be a lot of pro se ugly hookers in court today. (LVRJ)

  • Ed is best known for representing Charles Cashmore, one of the defendants in the O.J. Simpson robbery case. Cashmore was given a 12- to 36-month suspended sentence and up to three years of probation after pleading guilty to accessory to robbery. He then promptly violated his probation.

  • LV Now has a link to the arrest report.

Meet "Eviler Ed" ...

Not sure about you guys, but this is getting a little too Lincoln/Kennedy for us.

The ravishing Judge Stefany Miley's husband Ed Miley (yes, Ed ... just like that other guy) was arrested last Thursday on a domestic battery charge. From the LV Sun:
... [Judge Miley] called police from a neighbor’s house about 8:30 p.m. to report a domestic violence incident involving her husband, the report said. Miley told police at the neighbor’s house that her husband was “drinking heavily” and choking their dog, which had bitten him.

Miley said that when she tried to stop her husband from choking the dog, he pushed her to the floor in front of their children. Then she and her children fled to the neighbor’s house in fear, the report said.

Earlier in the evening, Miley said her husband had pushed her and struck her in the chest with the back of his hand.
Well, in all fairness, the odds of Ed's blow landing on her chest were pretty high. [Rimshot!] Eviler Ed continued his parade-o-class once police arrived:
Police said he told a lieutenant he “would like you to arrest better looking hookers because I am tired of defending ugly ones."
Well, maybe it's just that good-looking hookers actually have the money to hire decent representation. Besides, does Ed own a mirror?

If memory serves, Judge Miley's next appearance in the paper will be after she orders her bailiff to perform inappropriate favors. That lucky bastard.

(LV Sun, Thanks to everyone who sent this in!)

Charges Against Judge Miley Dropped (Likely Because She's Hot)

The Las Vegas city attorney has declined to prosecute a misdemeanor battery complaint against Judge Stefany Miley. The complaint arose out of a soccer mom fight Miley was involved in on May 19 at a soccer field in Summerlin.

The LVRJ got a look at the complaint filed by Rhonda Gold-Charbonneau:
According to the police report, Gold-Charbonneau said that Miley approached her and accused her of touching her children and talking about their family.

An argument ensued between the two women. At one point, a soccer coach unsuccessfully tried to get them to stop arguing, the incident report said.

Gold-Charbonneau alleged Miley then said, "If you ever touch my boys again," but didn't finish her sentence, according to the report.Gold-Charbonneau then contended that Miley, with a clenched fist, bumped her body into Gold-Charbonneau's, the report said.

Gold-Charbonneau asked Miley whether she wanted to fight, according to the report. "Suspect yelled 'Shut up' and she (victim) replied 'You shut up.'" The incident ended with Miley walking away, according to the report.
Sounds pretty tame to us, too tame. We were hoping for a little hair-pulling at a minimum. Needless to say, it looks like Miley lost at least one vote. Of course, she'll probably pick up a few male votes, so it's a wash.

Judge Miley involved in Soccer Mom Fight?

We've been hearing some rumors that Clark County District Court's judicial hottie, Judge Stefany Miley (Dept. 23), was involved in an altercation at a soccer field. The rumor is that she allegedly assaulted a soccer mom a few months back and that a police report was filed alleging assault and battery.

Well , turns out there is a police report filed with Las Vegas Metro:
Bill Cassell from @LVMPD confirmed Judge Miley's name was in a report about an altercation at a soccer game...no details, no charges yet. (KLAS investigative journalist Twitter account and George Knapp Twitter account)
We'll keep you updated as details come out because nothing would make us happier here at WWL than a cat fight between two soccer moms, one of whom wears the black robes by day.

Old malpractice suit against Judge Miley and her prior firm to be unsealed

In 2005, as Family Court Judge Stefany Miley was being sworn in, a widow sued the judge and her law partners for malpractice. The lawsuit was sealed by District Judge Doug Herndon at the time.

The Review-Journal reports:

[Judge Herndon] said last week that he sealed the matter by mistake and plans to unseal the lawsuit unless attorneys can convince him to do otherwise. Judge Doug Herndon said he didn't realize he had sealed the case in error until the Review-Journal inquired about it, and that he plans to call the attorneys on the Miley case back into court to justify the sealing of the case.
The sealed case alleges Miley and her old firm failed to file records with the court before a client's death:

The lawsuit, which was quickly sealed from public view, alleged that Carr-Blum's
husband, at the time of his impending death, signed legal documents to keep the couple's home out of probate, but that the law firm didn't file the records at the courthouse before he died, as required for Carr-Blum to assume sole ownership of the house.

The man died five days after he signed the documents in the presence of the law firm's paralegal, according to court records.

Kate Kruse, a law professor at the University of Nevada, Las Vegas, who teaches
professional ethics, said that for a lawyer to miss a deadline at court, resulting in a client being hurt, is a "pretty serious oversight." In a situation like the Miley case, it's possible the law firm had no way of knowing when its client would die and, therefore, had no idea that its deadline was imminent, Kruse said.

Even with just five days between execution and the client's death, it seems like the firm screwed up here. That said, consider the story in context: Miley's competition for the District Court judicial seat is Judge Halverson. Not a tough voting choice there.

Judging the Judges about their knowledge of the law

Shockingly, the Review-Journal reports that some lawyers believe judges favor local counsel who participate in "pay to play". (Review-Journal). Not familiar with that system? Just ask Plaintiff's super-attorney Robert Vannah about it--he has "five or six judges that will do anything [he] want[s]". Other attorneys see prejudice by jurists on the basis of religion/gender/ethnicity. (Review-Journal)

Meanwhile, some attorneys simply think the judges don't know or don't care about the law and procedure argued before them. (Review-Journal). Here are some highlights from the article:
  • Several lawyers commented in the evaluation that Judge Lisa Kent often was reluctant to take a position on cases. Judge Kent responded "It's a misconception that I don't know family law because I've practiced it my whole career." She said "I think I do a good job for children and families in Clark County."

  • A staggering 84 percent of respondents questioned how District Judge Elizabeth Halverson exercises the law, far and away the poorest rating of any jurist evaluated. [oh but her attorney is sure that's just because they're engaging in a "beauty contest". Why is this woman still on the bench? She is a national (and repetitive) black eye for Nevada law.]

  • 59 percent of attorneys said Judge Jesse Walsh was less than adequate in applying the law. She replied "I think my numbers reflect improvement." Her retention ratings have increased from 31 percent in 2004 to 34 percent in 2006 to 41 percent this year.

  • 48 percent of respondents said Judge Stefanie Miley was less than adequate in applying the law (the sixth lowest score of any judge in any court surveyed). Some attorneys noted "She appears to be only mildly interested in her job and more interested in furthering her own career." Miley said she has confidence in her ability and aspires to be on the Nevada Supreme Court.

Who's at the top for applying the law? Well, Family Court Judge Gloria Sanchez of course (who also has a 97% retention rating). And, as it should be, the Chief Justice of the Nevada Supreme Court Mark Gibbons. Congratulations to Justice Gibbons and Judge Sanchez for reminding us gossipy bloggers that the bench is also filled with the keenest legal minds.
