Attorney of the Day?

We're not sure if Stacey Chapman is an attorney (NV State Bar says she's not barred in NV), but if she is, the ad she posted on craigslist offering legal services (available here) makes her WWL's attorney of the day.

Super Stacey will apparently fight for you while flying around town in a form-fitting super dress. According to the post, she will:
. . . FIX TRAFFIC TICKET, DUI'S, WARRANTS AND CRIMINAL CASES NO POINTS ON YOUR RECORD (IN MOST CASES) NO TRAFFIC SCHOOL (IN MOST CASES) NO INSURANCE INCREASE NO COURT APPEARANCE
Personally, I've always wanted a super hero on my side, especially one that writes in ALL CAPS.

  1. Her Myspace lists her as graduating high school in 1993, the only Stacey on the NV Bar's website enrolled 6-7 years after 1993 is in L.A., so I would also guess she is not an attorney in Nevada.

    Her Henderson NV business license is listed as DMV Services/Mobile Notary - not any type of Legal Services.

    So - I hope she's simply referring people to another attorney to do her traffic ticket 'fixing'. Because if she's taking money from someone to 'fix' their ticket, hiring an attorney to do it for the person, and keeping part of the money paid, that sounds like accepting money for legal services which sounds like UPL.

    I guess she could take a 'referral' fee to refer the person to an attorney, but then would not the attorney then have a problem with such a referral arrangement according to the NV Rules of Professional Conduct?

    Hmm, I wonder which attorney she's referring work to?

  2. They would both have a problem. Fee-splitting.

    I believe she already has a problem because of the representation of assistance and there is no reference to a law firm to which the service is tied. I think she is just a little aggressive. She will need to cool it down or list the law office to which she is tied, unless there is not a fee being received. In that case, she would still need to state that she is an atty referral service.

  3. David Clark, the State Deputy Bar Counsel and General Counsel to the State Bar informed me this morning that they've sent a Cease and Desist Order.

    He also thought this was an interesting blog.
