The RJ reports that the award was issued from the bench by District Judge James Bixler. The judge cited that the plaintiff "will require periodic medical pain relieving procedures to control pain in her back, which will continue throughout the plaintiff's life due to the permanency of her condition."
$8.9 million for a 43 yr old woman's periodic pain. Well done, Mr. Horton. You didn't even have to sue inanimate plant life.

It was Vannah and Defense was a LSC probate attorney as well as a too little too late addition of someone experienced in ID.
ReplyDeleteThere are only a few lawyers who can go toe to toe with Vannah and none of them are at LSC - that's not what they do. Vannah's cases are always the same and always involve allegations of spine injury. If you bump your head and then go see Vannah, you've got a spine injury. Broken leg = spine injury. Infection? Spine injury. Inhale poison gas? Spine injury. Vannah knows how to try those cases and he tries them all the same. Unless the defense lawyer has figured out Vannah's schtick (and a few have), Vannah gets a big verdict. I'm wondering how the defendant in this case didn't figure that out. This isn't to say Vannah's not good. He is. But let's face facts; he's good at one thing. Well maybe two; he's also great at getting under his opponent's skin.

ReplyDeleteLSC's attorney is a probate specialist, end of story. Commentators spend a lot of time ragging on PI and ID but it doesn't mean you can handle one of these cases without experience i.e. asking all the right questions during depositions. Especially against Vannah.
Let's hear more from the previous commenter (8:34pm). Hilarious! It is true what they say though, most people only have a few good ideas/talents, and spend their life doing them over and over and over...

Uhh....if Horton worked it up until five months ago, and then let Vannah try it, then Horton did not "try" it. He may have worked it up and taken the depositions, but he sure as hell did not try it. This is Vannah's bread and butter. He frequently has attorneys bring him cases that they have worked up, but would rather have an actual trial attorney try the case. Litigating and trying are not always synonymous. This isn't people just upset with Horton. Rather, it's people telling the truth. Please tell us who gave the voir dire, opening, closing, examination, cross, etc. My money says it was not Horton.
ReplyDeleteThe attorney at LS&C is not a probate specialist. You need to check your facts. Also, Vannah did associate as counsel within the last few months, and Vannah is the one who tried the case. Vannah associated, in part, because Horton is a complete idiot and like most PI shops has no clue how to take a case to trial.

ReplyDeleteJohn Naylor from LSC was the defense attorney. His practice is big construction litigation. He was clearly out of his element here. This was a by-the-book Vannah spine trial with very few surprises. Someone at the insurance company screwed up big time. Vannah has made his fortune trying these. His witnesses do what he tells them to do.
ReplyDeleteTake 5 minutes to read Horton's website and you will learn that he does not need to associate counsel. It was just another smart move on Horton's part. The best part is that the client will benefit most from the verdict. One more satisfied client to add to the list.

Horton hit is first 1.2 million when he was 28 and 5.4 million at 35 without Vannah and keeps progressing. Look at the transcripts and you will see Horton took the Depos/Witnesses/ and argued the trial. As somebody who witnessed the TRIAL I know who argued and tried the case and Vannah did nothing but take 2 witnesses. Get the facts straight before assuming. Horton and Vannah are now being referred to as the DREAM TEAM because of Hortons work. So give the man his credit and stop trying to give it elsewhere.

Mr. Horton works the case for 4 years, files suit, and brings in Mr. Vannah. Make no mistake.... "F...n" Genius. You develop a reputation in this business and Bob Vannah's name carries a lot of weight. Mr. Horton can be considered the protege of Mr. Vannah. To be the best, you have to learn from the best, and Bob Vannah is the best. just watch and see... Dallas Horton will eclipse Bob Vannah as the best....... Make not mistake. If you do any kind of research on G. Dallas Horton, you will find that he owns 2 law firms. A personal injury firm and a Medical Malpractice Defense Firm. Imagine.....The medical knowledge you have to have to defend doctors against medical malpractice! Not many attorneys in town can bring that to the table. Look at Mr. Horton's trial record. 20 out of 21 ain't bad. The PI community knows who their studs are and Dallas Horton is one of the few. Remember, the fear of something is just as bad as that something.....sometimes even more. The attorneys for the defense knew what they were in for when Mr. Vannah was brought in late. What they didn't see coming was G. Dallas Horton. Make no mistake, G. Dallas Horton was lead counsel on this case and if you think otherwise, read the transcripts.... do your research. Final note.... If you unfortunately fall into a similar situation as Mrs. Burnside, I wish you luck when you hire Bernstein, Kutner, or Lerner to handle your case... Chances are, the case will eventually end up at Horton's....if you do your research and have an inch of common sense.
ReplyDeleteHello People! I am a previous employee of Dallas Horton it is quite evident that no one here has actually met the man. He settled his first case for over a million dollars at the age of 28. Also if anyone can remember he didn't need to associate Vannah in on the 5 millions dollar case he settled in 2007. If you really want to educate yourself about this case you should check Blackstone, that way everybody can quit guessing who was lead on counsel on this case and see it was G. Dallas Horton and read the transcript to see he TRIED the case.
